What is a Deed?
A deed is a written instrument that transfers title of real property to one person to another. The one who transfers the title is the “grantor” and the one who receives the title is the “grantee”. A deed must be in writing and signed by the grantor. In order for the deed to be effective against third persons and subsequent purchasers, the deed must be recorded in the land records of the county in which the property is located. At minimum, every deed must contain an identification of the grantor and grantee, a consideration (usually the amount of money paid) and legal description of the real estate.
